Following the withdrawal of criminal prosecution by the State Prosecutor (PGJE), between Wednesday and Saturday four of the ten indigenous adherents to the Other Campaign have been released. [They were] arrested on 3rd February, at the tourist centre at the Agua Azul waterfalls, after a clash with ejidatarios, members of the PRI, from San Sebastian Bachajón in the municipality of Chilon, which left one dead and two wounded.
Unofficial sources said that Pedro Garcia Alvarado, who reportedly has learning difficulties, and who was accused of crimes, damages and attacks in breach of the peace of the community, was released on Wednesday night. They adeed that between Thursday and Saturday, Alvaro Miguel Deara, Pedro Hernández López and Miguel López Deara were also released
One of the six who are still in prison, Mariano Demeza Silvano, who is less than 17 years of age, was on Friday set bail of 22 thousand pesos to be released. It is likely that, in the coming days or weeks, the other five who are currently in the prison located in the municipality of Playas de Catazaja, in the north of Chiapas, may be released, said the sources.
In this context, the Fray Bartolome de las Casas Human Rights Centre reported that the communal landholders of San Sebastian Bachajon, adherents to the Other Campaign, filed an injunction against the construction of the tollbooth that is being built by the state government, through the secretaries of Infrastructure and Treasury, saying that they signed an agreement on the 13th February “illegally and arbitrarily, since the assembly was not consulted”
Ricardo Lagunes, lawyer for the organisation, said that the construction of the tollbooth, which is disputed by two groups of ejidatarios, affects the collective rights of the ejido San Sebastián Bachajón as a community, as an agrarian centre and as indigenous people.
He added that the Seventh District Court will decide on the injunction filed in recent days to suspend immediately the construction in an area of common usage.
